Terms of Service

1. Acceptance of Terms

By accessing or using the RealCents website or application (the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, you must not use the Service.

These Terms constitute a binding agreement between you and RealCents Pty Ltd (ACN to be registered) ("RealCents", "we", "us"). We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

2. The Service

RealCents is a property information and education platform designed to help Australians understand property options, including cash flow analysis, grant eligibility, suburb intelligence and affordability tools.

The Service is available on a freemium basis. Certain features require a paid Premium subscription. We reserve the right to modify, suspend or discontinue any part of the Service at any time with reasonable notice to registered users.

3. Not Financial Advice — Important Disclaimer

RealCents is a general information service only. Nothing on the Service constitutes:

• Financial product advice within the meaning of the Corporations Act 2001 (Cth)
• Investment advice, tax advice or legal advice
• A recommendation to buy, sell or hold any property or financial product

All data displayed — including cash flow estimates, yield figures, grant amounts, suburb growth indicators and AI-generated insights — is based on publicly available information and estimated models. It may be incomplete, inaccurate or not applicable to your personal circumstances.

You should always obtain independent advice from a licensed financial adviser, mortgage broker, accountant or solicitor before making any property or investment decision. RealCents does not hold an Australian Financial Services Licence (AFSL).

4. Eligibility and Account Registration

You must be at least 18 years of age to use the Service. By registering, you confirm that the information you provide is accurate and that you will keep it up to date.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@realcents.com.au if you suspect unauthorised use of your account.

5. Subscriptions and Payments

The Free plan is available at no cost with limited features. Premium plans are available on a monthly ($19.99/month) or annual ($119.99/year) basis.

• All prices are in Australian Dollars (AUD) and include GST where applicable
• Subscriptions renew automatically unless cancelled before the renewal date
• You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period
• We do not offer refunds for partial billing periods, except where required by Australian Consumer Law
• We reserve the right to change pricing with 30 days' notice to existing subscribers

6. Australian Consumer Law

Our Service comes with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Scrape, copy or redistribute data from the Service without our written permission
• Attempt to gain unauthorised access to our systems or another user's account
• Use the Service to provide financial advice to third parties
• Reverse engineer, decompile or attempt to extract the source code of the Service
• Impersonate any person or entity or misrepresent your affiliation with any person or entity

8. Intellectual Property

All content, designs, trademarks, data models and software within the Service are the intellectual property of RealCents Pty Ltd or our licensors. Nothing in these Terms grants you any right to use our intellectual property other than to use the Service as intended.

You retain ownership of any content you submit to the Service (such as saved properties and preferences). By submitting content you grant us a non-exclusive licence to use that content to provide and improve the Service.

9. Third-Party Data and Services

The Service incorporates data from third-party sources, including property listing data, suburb statistics and government datasets. We do not warrant the accuracy, completeness or currency of third-party data. Third-party services linked from the Service are governed by their own terms and privacy policies.

AI-generated insights (AI Location Intelligence) are based on publicly available information processed by AI models. These insights are provided for general informational purposes only and may not reflect current conditions.

10. Limitation of Liability

To the maximum extent permitted by law, RealCents' total liability to you for any claim arising from your use of the Service is limited to the amount you paid us in the 12 months preceding the claim, or $100 AUD, whichever is greater.

We are not liable for any indirect, incidental, consequential or punitive damages arising from your use of the Service, including any property purchase decisions made in reliance on information displayed in the Service.

Nothing in these Terms limits any rights you have under the Australian Consumer Law that cannot be excluded by contract.

11. Termination

We may suspend or terminate your access to the Service if you breach these Terms or if we reasonably believe your use poses a risk to other users or the integrity of the Service. You may terminate your account at any time by contacting us at hello@realcents.com.au.

12. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of Victoria, unless the Australian Consumer Law or another applicable law provides otherwise.
